ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

Though CIS has your correct address, non-delivery could be due to a typo in the address, and the USPS sorting system was not able to sort this particular letter.

Hi,
My brother is coming to USA on L1 visa.
His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.
Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?

As of April 15, 2010, approximately 13,600 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html)-subject petitions had been filed. USCIS has approved 5,800 H-1B petitions for aliens with advanced degrees.
Many immigration lawyers are seeing a sharp decline in the interest in the H1B visa this year by potential employers and workers. Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.
We shall see how the number will play out in the next few months.

Thought this might be helpful to those who are planning to travel. You fill in your nationality, country of residence, destination country and connecting country and it will give your transit visa requirements in detail.

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

In 2007 , I joined a new company and filed my Labour substitution+I140 petition in June 2007. This got approved in November 2007. but my H1B transfer to this company is still not approved. Earlier this year (2008) I went back to my previous company whose H1B is still valid and waited for my old H1B to get approved with no luck.
Now, i wish to start my GC process with this new company, can I retain my old priority date of I140 ? There is absolutely no chance that I will get I-140 approval copy from my old employer, but I have the receipt Number and I know the PD.
Any help is appreciated.

Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. I am trying to get an infopass to check my I-485 status
1. After selecting "you need information or other services" in the infopass process, The infopass is not showing me any appointment dates, instead it is showing "At this time, there are no information appointments available for the office in your area. Please try back again later."
I have done infopass before 6 months ago, and it showed me the date to select but now it is now doing that. just the message "At this time, there are no information appointments available for the office in your area. Please try back again later."
Does anyone faced the same issue and help me to get an infopass!

HI All,
I have 3 questions
1)what should be the time period between the Job switch from one employer to another after 6 months of filing of I-485.(AC-21)
2)Is it required to be employed until i get my actual GC ?
3) I am in the period of AC-21 (i.e 180 days completed after my I-485 filing)
If I marry to GC holder . Do i still have to maintain my independent status of I-485 or i can be given some status because of marrying to him..
