Yes you can file for 485 even if you have 140 pending.
Since all categories are current as of july 1st, can i file for 485/EAD/AP even if my 140 is still pending. thanks.

Most people have now heard about Stephen Colbert's testimony in front of the House Immigration Subcommittee this week on the subject of new laws for migrant farmworkers. Some have criticized the Committee for letting the comedian speak. I say, how high can the standards be if they let me testify? My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

My I-485 has been pending for more than 6 months now. I have an EAD but I got an RFE on my AP. I don't know what its about as I have not received the RFE yet.
I am thinking of changing my job. In my new job I don't want to use my EAD since my AP status is still hanging. Can I keep working on H1-B visa as I still have 3.5 years left on my H1? If I travel outside the country, can I re-enter with a valid H-1B visa? Can this cause an abandonment of AOS if I enter on H-1B while my AOS is pending? Please let me know. Thank you.

BUT I have heared that if she gets some research-work in any University / non-profit organisation, they do give special work permit immediatly unlike H1 where u have to wait till October... IS THIS TRUE?

My I-140 was submitted to USCIS in June, 2006 and got approved in August, 2006 and my employer has received the approval notice. I am checking the case status online but it is still showing up that my case is in pending till date. One of my friends is also in the same situation, his I-140 got approved recently and he received approval notice copy from attroney but the case did not update on the USCIS web site as approved. When I called USCIS, they told me that this needs to be reported by my lawyer and not me. When I talked to my attroney on this, she told me that we don't need to worry about this as the approval notice is available with us. But if the case update showing up correctly, atleast I could show that as a proof for my priority date portability if I switch the employer. Does anyone experienced the same problem and appreciate the suggestion as to how this can be corrected. Thanks in advance.

Dear lawyer,
my I-485 is pending; PD is oct 05.
my Labor Cert shows that we use job description of programmer/analyst. ETA Case shows title as "Software Engineer"
I have a job offer in Information Technology, will there be any problems if I use AC21 with the new company?
I have not yet accepted the offer.

There's something about these that isn't working. I think klinux is right. Try some other levels of desaturation. I like the headshot the best of the two. The color shot is a nice one, but her skin looks blotchy. Good experiment. Keep trying.
